HYDRAFACIAL MEMBERSHIP AGREEMENT



This Membership Agreement is entered into this day of , 20 (“Effective Date”) by and between MIAMI WELLNESS & AESTHETICS CENTER (“We” or “Us”) and Member (“You”) and will continue on a month to month basis on the 1st of each month until (14) days following a written cancellation is received.

1. Membership Fee

You have elected to pay $150 on a monthly basis for a membership term starting on the effective date stated above. Following the initial month term, you understand and acknowledge that your membership will automatically continue on a month-to-month basis at $150 until your membership is cancelled. Membership will be charged at the 1st of each month. Memberships started in the middle of the month will be charged at the time contract is signed, then at the 1st of each month thereafter.
By signing below Member authorizes Us (or our authorized representative) to charge the credit/debit card presented by the Member for all charges incurred by the Member including monthly membership dues and other ancillary charges incurred by the Member in association with his/her membership.

2. Terms of Membership, Conditions and Cancellation

Unless provided otherwise by applicable law, you may freeze your membership only if, after the (3) month minimum commitment period you: (a) advise us within (14) days of your request. Further once the membership has been effectively billed for the initial (3) minimum commitment period, the member may cancel his/her membership for any reason with a (14) day written notice, or such other notice required by law. In order to prevent you from being billed beyond the desired duration of your membership, all cancellation requests must be submitted in writing to appointments@drhamadiya.com at least (14) days prior to your next billing cycle.

Services and discounts ARE NOT transferable to anybody else. The only person who is able to use the membership benefits is the person whom the membership belongs to. There are no exceptions. Additionally, services do not rollover to other months. Ex. A client cannot receive two Signature Hydrafacials for the month of February if they didn’t use their Signature Hydrafacial in January. All services must be rendered monthly.

Member agrees to be bound by the terms of this Agreement and all previously executed acknowledgements on file which are incorporated herein. We reserve the right to revoke a client’s membership with a (30) day notice by mail or email.

Membership will be charged at the (1st) of each month. Memberships started in the middle of the month will be charged at the time services are rendered, then at the 1st of each month thereafter. If the member wants to wait to start membership until the (1st) of the month, they will only be able to render services and applicable discounts once their membership has already started.

3. Acknowledgment of Risks Associated with Services.

MEMBER ACKNOWLEDGMENT

By signing below Member acknowledges that Member has read this Membership Agreement and the Terms and Conditions of Membership in their entirety, has had the opportunity to discuss same with a member of our staff, and fully understands and accepts all Member obligations, rights, responsibilities, liabilities and waivers under the Membership Agreement and Terms and Conditions of Membership. Member acknowledges that neither Miami Wellness and Aesthetics Center, nor anyone else, made any representations or promises upon which you relied that are not stated in this agreement. This document contains the entire agreement between you and Miami Wellness and Aesthetics Center and replaces any oral or other written agreement. If a court declares any part of this agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Miami Wellness & Aesthetics Center does not enforce any right in this agreement for any reason, Miami Wellness & Aesthetics Center does not waive its right to enforce it later. Member further acknowledges that the recurring payment provisions (charges to debit or credit card), automatic renewal provisions, and cancellation procedures and applicable dates have been thoroughly explained.
